Power of Attorney for Tenerife Inheritance: How It Works

Most heirs don’t live in Tenerife.

They’re in the UK. Germany. Scandinavia. Somewhere cold and grey usually.

Flying over just to sign paperwork at a notary isn’t always practical. Or cheap.

That’s where Power of Attorney comes in.

Used properly, it makes the whole inheritance process far simpler.

What Is a Power of Attorney?

A Power of Attorney, or Poder Notarial, is a legal document.

It gives someone permission to act on your behalf in Spain.

In inheritance cases, that usually means your lawyer handles everything while you stay exactly where you are.

No airport queues.
No last minute flights.

What the POA Normally Allows

A standard inheritance POA usually authorises your representative to:

  • Sign the inheritance deed
  • Pay taxes and official fees
  • Deal with Spanish banks
  • Collect certificates and documents
  • Register the property in your name
  • Transfer utilities and services

If you also want the property sold, that must be specifically written into the POA.

It’s not automatic.

If selling might be an option, say so from the start.

How to Make a Power of Attorney Abroad

It’s straightforward:

  • Visit a notary in your home country
  • Sign the POA in front of them
  • Obtain an Apostille stamp
  • Send the original document to Tenerife

In some countries, you can also sign it at a Spanish Consulate instead of using a local notary.

Once your lawyer receives the properly apostilled POA, they can complete the inheritance process without you needing to travel.

It won’t remove Spanish bureaucracy… nothing can do that.

But it will remove the need for multiple flights just to sign papers.

For most families, that alone makes it worth doing.
